Acceptable Use Policy
The conduct we expect when using our website and services, and the standards we hold ourselves to.
This Acceptable Use Policy sets out the standards that apply when you use the Xephlo website, communicate with us through any channel, or use any product or service we provide. It exists to keep our platforms safe, lawful, and reliable for everyone. It forms part of our Terms of Service.
This policy runs in both directions. Sections 01 to 03 set out what we ask of you. Section 04 sets out the commitments we make to you about how we communicate.
01Prohibited Activities
When using our website or services, you agree not to engage in any of the following:
- Using our website or services for any unlawful, fraudulent, or harmful purpose.
- Attempting to gain unauthorised access to our systems, accounts, or networks.
- Introducing malware, viruses, or any code designed to disrupt or damage systems.
- Scraping, harvesting, or collecting data from our website without permission.
- Interfering with the proper operation of our website, including denial-of-service activity.
- Impersonating any person or entity, or misrepresenting your affiliation with anyone.
- Submitting another person's mobile number, email address, or personal information without their knowledge and permission.
02Content Standards
Any content you submit to us, including messages and project materials, must be accurate, lawful, and must not infringe the rights of others or contain material that is defamatory, obscene, or otherwise objectionable.
Do not send us credentials, passwords, API keys, or payment card details by text message or unencrypted email. If a project requires us to handle sensitive material, tell us and we will arrange a secure channel.
03Messaging Conduct
These standards apply to messages exchanged with us by SMS, WhatsApp, email, or any other channel.
- Do not send content that is unlawful, threatening, harassing, hateful, or designed to defraud.
- Do not use our messaging channels to send unsolicited commercial messages, chain messages, or bulk content.
- Do not send, request, or discuss content in the categories that mobile carriers prohibit outright: cannabis, alcohol sales to unverified recipients, firearms and ammunition, tobacco and vaping products, illegal drugs and paraphernalia, sexually explicit content, gambling, high-risk or predatory lending, debt collection or credit repair offers, multi-level marketing, and cryptocurrency or securities promotions. We do not send messages in these categories and cannot receive or forward them.
- Do not use our number to reach a third party who has not consented to be contacted.
If you receive a message that appears to come from Xephlo but breaches these standards, it did not come from us. Please report it using section 07.
04Our Own Messaging Commitments
We hold ourselves to the following, for every recipient and every channel:
- We only message people who have asked us to. We obtain consent before sending text messages, we record how and when it was given, and we do not treat a general enquiry as consent to be texted.
- We never require consent as a condition of anything. Declining messages has no effect on the service or pricing you receive.
- We honour opt-outs promptly and permanently. Reply STOP to any text and we stop, and we do not re-add you to any list unless you opt in again.
- We identify ourselves in every message, so you always know who is contacting you and why.
- We do not send marketing or promotional text messages, and we do not message on behalf of third parties.
- We do not sell or rent your contact information to any third party. We share it only with the service providers and the registered marketing and communication tools we actively use to reach our own customers, each of which is contractually bound to act on our instructions alone. Mobile opt-in data and text-message consent are excluded from even that sharing and are never passed to a marketing tool. See our Privacy Policy.
- We do not buy contact lists or message numbers obtained from any source other than the person themselves.
- We keep messaging volumes proportionate to the work at hand, and we use the channel you have told us you prefer.
These commitments reflect our obligations under Canada's Anti-Spam Legislation (CASL), the US Telephone Consumer Protection Act (TCPA), and the messaging policies of the mobile carriers who deliver our messages.
05Security
You must not probe, scan, or test the vulnerability of our systems, or breach any security or authentication measures, without our prior written consent. Responsible disclosure of genuine security issues is welcome and can be reported using the contact details below. We will not pursue action against researchers who report issues in good faith, avoid privacy violations and service disruption, and give us reasonable time to remediate before disclosing publicly.
06Consequences of Violations
We may investigate suspected violations of this policy and take any action we consider appropriate, including restricting or terminating access to our website or services, ceasing communications, and reporting activity to law enforcement or the relevant carrier where required.
07Reporting a Concern
To report a security issue, a message you believe was sent improperly, a message impersonating Xephlo, or any other breach of this policy, email info@xephlo.com with the details, including the number or address involved and the date and time. We investigate every report and aim to acknowledge within one business day.
